Constitution of the Associated Dental Students of the University of California at San Francisco School of Dentistry
PREAMBLE
We, the students of the University of California, San Francisco, School of Dentistry, by the authority of the President of the University and the Chancellor of this campus, and the Dean of the School of Dentistry, in order to provide for the promotion, maintenance and regulation of such matters as are delegated by them to the student government, do ordain and establish this constitution (hereinafter “this Constitution”).
GENERAL PROVISIONS
Student Body Name. The name of the student body shall be the Associated Dental Students, hereinafter referred to as the “ADS.”
Purpose of Constitution. The purpose of this Constitution is to provide and regulate student government and activities in harmony with the rules and regulations of the University of California, the School of Dentistry and the Associated Students of this campus (the “ASUCSF”). The direction and guidance of these activities will be in accordance with the professional standards set by our peers.
Goals. The goals of this Constitution and the government structures created by this Constitution, include, but are not limited to, the following:
To serve as liaison between the University, the School of Dentistry, and its students;
To provide equitable disbursement of acquired funds to ADS-sanctioned student organizations;
To provide opportunities for the development of leadership and responsibility through student government participation; and
To encourage professionalism and uphold the Student Honor Code.
Membership
All registered Dental and Dental Hygiene students of the UCSF School of Dentistry are members of the ADS.
Graduate students and/or residents associated with the UCSF School of Dentistry are not considered ADS members but may participate in ADS activities upon payment of activity fees as determined by the Executive Council.
CLASS GOVERNMENT STRUCTURE
General Structure
The ADS recognizes six classes: Freshman (D1), Sophomore (D2), Junior (D3), and Senior (D4) Dental classes and the Junior (DH1) and Senior (DH2) Dental Hygiene classes. Each class will nominate and cast votes for its own officers to execute the necessary responsibilities and business of the class.
Powers and Responsibilities. The powers and responsibilities of each Class are:
To conduct social and recreational events, conduct programs, and form intramural teams;
To organize and hold class meetings as necessary;
To supply representation to various groups and committees as detailed elsewhere;
To organize commencement activities in the last year of the class;
To establish, at the election of the class, a self-insurance program for lost or stolen instruments;
To be responsible for the conduct of its members; and
To recognize that the ADS Constitution, any subsequent amendments, resolutions of the ADS Executive Council, or decisions of any ADS-empowered board or committee shall take precedence over the constitution or resolutions of any individual class.
Class Officer Position Descriptions
Class President
General Duties. Each Class President:
Will represent the class as a voting member of the ADS Executive Board;
Will be primarily responsible to represent the opinions and concerns of the class to the administration, faculty and staff, and to act as liaison for the class;
Will be designated as a co-facilitator, with the ADS President, to seek informal resolutions of student peer-review complaints, i.e. academic dishonesty, originating from fellow students;
Will be responsible for representing the class, or sending a proxy, to all of the following bodies:
Student Liaison Committee; School of Dentistry Ethics Committee; ADS Executive Board; Award Ceremony Advisory Committee; and Student Affairs Advisory Committee;
Will work with the other Class Officers and the ADS President to appoint representatives to other appropriate groups as necessary.
Specific Duties
The D4 President will hold office for the duration of the Senior year, throughout the Spring Quarter. Furthermore, the D4 President will attend the following Committees:
State Board Coordinating Committee; and
Commencement Ceremony Committee.
The D3 President will serve as the student liaison for he organization of the School Annual Picnic.
Class Vice President
General Duties. Each Class Vice President:
Will act in an advisory capacity to the Class President, and is responsible for fulfilling the President’s duties in her/his absence;
Will, in the case of dental students, represent the class as a voting member of the ADS Executive Board; and
Should carry out duties delegated to him/her by the Class President.
Will serve on the Pride-a-Thon committee to assist the Dental 2 Vice President in the organization and execution of Pride-a-Thon.
Specific Duties
The D2 Class Vice President will chair a committee to organize an annual Pride-a-thon to raise funds for maintaining the upkeep of, and purchasing new equipment for, the school’s pre-doctoral laboratories and simulated laboratories.
The following Class Vice Presidents will serve on the Admissions Committee:
D2, D3, D4, and DH2 Vice Presidents will serve as primary representatives; and D1 and DH1 Vice Presidents will serve as alternate representatives.
Class Secretary. Each Class Secretary:
Will be responsible for keeping accurate minutes of the class meetings, lists of class members; and
Will organize and oversee activities such as notepools, testpools, and advertisements of class meetings.
Class Treasurer.
General Duties. Each Class Treasurer:
Will be responsible for all financial dealings of the class, including, at the election of the class, the establishment of a self insurance program for lost or stolen instruments; and
Will establish and maintain the class bank account, records of dues, miscellaneous collections and debits, check book and financial statements.
Specific Duties. The D2 Treasurer will be responsible to represent the School of Dentistry students to the Financial Aid Advisory Committee.
Class Social Chairperson(s). The position of Class Social Chairperson may be occupied by two individuals, and each Class Social Chairperson:
Will be responsible for organizing class activities such as: parties, dinners, picnics, social events, and ADS functions;
Should work with the ADS Social Chairperson(s) when arranging the calendar in order to minimize scheduling conflicts; and
Will work with the ADS Social Chairperson(s) in organizing the school events.
Associated Dental Students Government Structure.
General Structure.
The ADS is the student body of the school.
Each registered Dental and Dental Hygiene student is a member of the ADS.
The governing body is the Executive Council composed of the Cabinet and the Executive Board.
The Cabinet
The five elected cabinet positions are: President, Vice President, Secretary, Social Chairperson(s) and Editor-in-Chief.
The one appointed cabinet position is the ADS Treasurer, who, subject to the advice of the Treasurer Search Committee described in this Constitution, shall be appointed and approved by a 2/3 majority of the new Executive Council during the first ADS meeting after Spring Quarter Elections.
Cabinet members may introduce resolutions and may vote, with the exception of the President, who may vote only when necessary to break a tie, and the ADS Treasurer.
The Executive Board.
The members of the Executive Board shall consist of the President and Vice President of each of the Dental and Dental Hygiene classes, and one representative each from the American Student Dental Association, the California Dental Association, the American Association of Dental Schools, the Student American Dental Hygiene Association and any other nationally recognized organized dentistry group or association that conducts elections for officers before the entire ADS or before a class within the ADS, and the membership of which automatically includes each member of the ADS or each member of the dental or dental hygiene classes and is subject to demands for dues (individually, an “Organized Dentistry Group,” collectively “Organized Dentistry Groups”). The Executive Board shall not consist of any representative from any organization recognized by the Executive Council as a dental registered campus organization (individually, “RCO,” collectively “RCOs”).
Each Dental class shall have two votes and each Dental Hygiene class shall have one vote on the Executive Board and Executive Council. Each representative from an Organized Dentistry Group shall have one vote on the Executive Board and Executive Council. Representatives from dental RCOs shall not have any vote on the Executive Board and Executive Council.
The Executive Council. The Executive Council:
Will consist of all members of the Cabinet and the Executive Board;
Will exercise authority over any activity, affair, or transaction which involves the use of the facilities, funds or name of the ADS;
Will respond to requests from UCSF schools, groups, departments, or organizations regarding the activities, concerns or intentions of Dental and Dental Hygiene students; and
Will act as a channel for student body problems or concerns to be brought to the attention of the faculty, staff, and administration.
Cabinet Officers
General
In addition to the regularly scheduled ADS meetings, the Cabinet will meet at the discretion of the President, and will coordinate ADS activities and assist Class Officers in their duties.
All Cabinet Officers shall, after the Spring Election assist all incoming Cabinet Officers in the efficient assumption of the new duties and obligations.
ADS President. The ADS President:
Will function as Chairman for the following:
ADS Cabinet; ADS Executive Council; Student Liaison Committee;
Will officially represent the student body to the following:
School of Dentistry Ethics Committee; Faculty Council of the School of Dentistry; ASUCSF Executive Council; Educational Policy Committee; Award Ceremony Advisory Committee; Dean’s Disciplinary Hearing Committee; and State Board Coordinating Committee;
Will be responsible to organize and conduct, with appropriate Class Presidents, meetings with individual students to attempt to resolve complaints of student misconduct, i.e., academic dishonesty, brought about by fellow students, at an informal level, and to appraise all involved parties of the formal complaint process as described in the UCSF School of Dentistry Student Honor Code;
Will be responsible for keeping the ADS copy of the Dean’s Administrative Manual (DAM);
Will properly sample and understand the attitudes, perceptions and concerns of the entire student body so as to accurately represent the same;
Will be responsible to provide names of official student committee representatives to the Dean, Faculty Council, and other appropriate bodies;
Will effectively communicate to the student body regarding student issues on the behalf of the committees or meeting she/he attends;
Will offer advice to Class Presidents, officers and representatives as needed in the proper execution of their positions;
Will be a voting member of the ADS Cabinet and Executive Council in the event of a tie;
Will exercise the necessary power to carry out the policies of the Executive Council;
Will review all statements of bank account activity provided by the ADS Treasurer each month;
Will have the authority to co-sign with the ADS Treasurer checks for amounts greater than $150;
Will appoint members to the Constitution Committee as described in this Constitution; and
Will serve on the Treasurer Search Committee.
ADS Vice President. The ADS Vice President:
Will, in the absence of the ADS President, administer the duties of the President;
Will carry out any additional duties delegated to her/him by the President;
Will manage and insure the integrity of all Class Officer elections and ADS Officer elections and ADS-sponsored elections and will publish the results for those elections;
Will officially be a member of the following:
Student Liaison Committee; School of Dentistry Ethics Committee; ADS Cabinet and Executive Council; Educational Policy Committee; Dean’s Disciplinary Hearing Committee; and Dean’s Advisory Committee on Health and Safety;
Will serve on the Treasurer Search Committee; and
Will be a voting member of the ADS Cabinet and Executive Council.
ADS Treasurer. The ADS Treasurer:
Will serve, as necessary, as the financial representative of the ADS before the ASUCSF and will not be a voting member of the ADS Cabinet and Executive Council;
Will prepare the ADS budget, along with the ADS President and the Executive Board, in accordance with the provisions of Section B of Article VI of this Constitution, for submission to the Dean;
Will establish and maintain such appropriate bank accounts (checking or savings) as selected by the ADS Treasurer, with each account having a co-signing requirement for checks having an amount greater than $150;
Will establish and maintain such financial records and reports as may be required by the Executive Board and make appropriate adjustments in the amounts and types of budget accounts in the ADS budget;
Will, within ten (10) calendar days of submission of a written reimbursement request, verify receipts, confirm that the request is for funds from an approved budget account, and either:
Notify the individual submitting the request that the request cannot be honored because:
The person did not complete the appropriate forms for a reimbursement request (as prescribed by the ADS Treasurer);
The submission does not request funds from an approved budget account;
The approved budget account has insufficient funds to cover the request; or
The dental RCO submitting the request has either failed to attend ADS meetings on a regular basis or has failed to submit an article explaining its campus activities to the Editor-in-Chief on a regular basis; or
Reimburse the person submitting the request with a check for funds from the approved budget account.
Will submit requests denied for insufficient funds, upon the election of the person who was denied the requested reimbursement, to the Executive Board for approval so long as the ADS Treasurer can identify a new source of funds;
Will have the authority to sign checks for amounts less than $150, and to co-sign, with the ADS President, checks for amounts greater than $150;
Will provide the ADS President with all statements of bank account activity each month and will provide financial statements to any ADS member upon reasonable request;
Will create such forms as are necessary or appropriate for reimbursement requests and budget proposals; and
Will serve on the Treasurer Search Committee.
ADS Secretary. The ADS Secretary:
Will distribute copies of the ADS Constitution to all members of the Executive Council at the beginning of each new term;
Will transfer all ADS records to the new ADS Secretary on the expiration of his/her term;
Will officially be a member of the Student Liaison Committee;
Will be responsible for recording and keeping the minutes of Cabinet, Executive Council and Student Liaison Committee meetings;
Will be responsible for arranging and administering use of copy services for ADS;
Will compile, keep and publish current rosters, i.e., position, phone numbers, etc., of all Council members as needed;
Will be responsible to advertise meetings or communications falling under ADS Sponsorship or jurisdiction;
Will be responsible for the posting of notices and other activities relating to elections as specified in this Constitution; and
Will be a voting member of the ADS Cabinet and the Executive Council.
ADS Social Chairperson(s). The position of ADS Social Chairperson may be occupied by up to three individuals, and each Class Social Chairperson:
Will work with the dental and dental hygiene classes, fraternities, clubs, groups, and various School and Campus organizations to keep a current activities calendar and minimize scheduling conflicts;
Will organize and arrange social functions for the ADS;
Will keep an accurate list of ADS-sanctioned group members who are afforded privileges (i.e., to attend functions at no charge, etc., as determined by the Council); and
Will be a voting member of the ADS Cabinet and the Executive Council, and if the office is held by more than one person, then the group shall retain one vote.
Editor-In-Chief. The Editor-in-Chief:
Will be a voting member of the ADS Cabinet and Executive Council;
Will produce a quarterly newsletter, except for the summer session;
Will establish a mode of quarterly newsletter distribution;
Will seek donations to finance the quarterly newsletter. May recruit a representative from each class and maintain a staff to produce a quarterly newsletter; and
Will, in association with the ADS Vice President, publish ADS and Class Officer election results.
Meetings of the Executive Council.
The Executive Council will meet once a month in meetings called “ADS meetings.”
The Executive Council may call special sessions as needed by a simple majority of the Council members.
A quorum of 2/3 of all Executive Council members is necessary for any formal business and/or voting to occur.
All regular and special meetings shall be open to all members of the ADS, unless by a 2/3 majority of the Executive Council, votes to close the meeting.
No formal voting may occur during a closed meeting.
The ADS President will preside over all meetings. In her/his absence, the following order of succession will be observed: ADS Vice President, ADS Treasurer, ADS Secretary, ADS Social Chairperson(s), ADS Editor-in-Chief.
Minutes should be available to any ADS member upon reasonable request.
ELECTION CODE
Election Types. The following matters shall be submitted to the ADS, or classes within the ADS, for a vote pursuant to:
ADS Officer elections;
Class Officer elections;
Elections involving Organized Dentistry Groups; provided that this Article’s provisions may be modified by constitutions approved by the ADS or the Executive Council; and
Special elections (“Special Elections”), which shall include the following:
Initiatives duly submitted to the ADS; and Amendments to this Constitution.
Election Officials.
Election Disputes. The Executive Board has the responsibility for resolving disputes arising from the election process.
Supervision by ADS Vice President. The ADS Vice President shall organize and supervise the conduct of all elections before the ADS or any class of the ADS and shall have the following specific responsibilities:
Keeping the Executive Council appraised regarding the status of the election process at any given point;
Recruiting adequate help to perform these duties;
Advertising all election procedures and deadlines in a timely fashion;
Notifying the ADS of all available ADS Officer and Class Officer positions and the duties relating to each position;
Soliciting and receiving nominations from all classes;
Conducting or arranging debates and campaign speeches;
Printing and securing ballots before and after elections;
Locating and operating polling stations;
Counting the ballots;
Notifying candidates about the election results;
Publicizing election results to all students, departments and the parties;
Finding a non-partial non-candidate to operate polling stations and count ballots if the current ADS Vice President is a candidate in that election; and
Performing any other duties that are necessary or incidental to the conduct of elections and that are not otherwise specifically delegated to another ADS Officer or the Executive Board, including, but not limited to, promulgating interim regulations that govern the conduct of elections and that are not inconsistent with this Constitution.
Assistance by ADS Secretary. The ADS Secretary shall assist the ADS Vice President in the conduct of the elections and shall have the following specific responsibilities:
Posting notices relating to elections;
Making certifications as required by this Constitution;
Collecting and posting any candidate statements for ADS officers and Class Officers;
Collecting and posting all statements supporting and opposing initiatives;
Collecting and posting all statements supporting and opposing amendments to this Constitution; and
Maintaining originals of any of the foregoing until the completion of the applicable election.
General Provisions
Officer Election Dates. Elections for ADS officers and Class Officers shall be held concurrently during the third full week of the Spring Quarter, while D1 and DH1 elections shall be held during the third full week from the date of first required attendance (such as any Pre-Fall Session).
Special Election Dates. The ADS President shall specify dates for all Special Elections.
General Eligibility Requirements.
Candidates shall be in good academic standing and have a cumulative grade point average of 2.0 or higher.
Candidates may nominate themselves for any ADS Officer or Class Officer position.
Candidates may not run for more than one ADS Officer or Class Officer position at the same time. No person shall hold more than one Class Officer or ADS Officer position at the same time.
Specific Eligibility Requirements.
Candidates for ADS President must be a Junior (D3) dental student. If no D3 student wishes to run for this office the next class that may run would be a Sophomore (D2), then a Freshman (D1) in succession.
Candidates for ADS Vice President shall be limited to Sophomore (D2) dental students. If no D2 student wishes to run for this office, the Junior (D3) dental students shall then be eligible for ADS Vice President. If no D3 student wishes to run for this office, the Freshman (D1) dental students shall be eligible for ADS Vice President.
Any D1, D2, D3, and DH1 may run for all other ADS Cabinet offices for the following year.
Ballots.
All elections must be by secret ballot.
Ballots must be:
Printed with:
Names of all candidates who have applied by the advertised deadline; or
A question asking whether an initiative or amendment to the Constitution, which initiative or amendment shall be written in full or copies of which shall be made available at all polling places, be approved by the ADS; and
Kept safe, secure, and accounted for before, during, and after the election period.
The names of individual candidates shall be listed on the ballot under the office sought by the candidate. No ballot shall specify slates of candidates, but a candidate may advertise and campaign as part of a slate of candidates.
Election Validity & Outcomes.
An election shall not constitute a valid election unless either:
At least 25% of the eligible ADS members cast votes in the ADS-sponsored election; or
At least 50% of the eligible members of a class cast votes in an election for Class Officers.
A simple majority of votes cast will determine the election outcome, except for amendments to this Constitution which shall require a two-thirds majority of the votes cast in the Special Election.
When multiple candidates compete for single office, the one with the most votes will be determined as the winner. Runoff elections will be held only in the case of a tie.
Senior Voting Restrictions. Senior Dental and Dental Hygiene students may not vote in the regular Spring Quarter Class and ADS election, but they may vote in any Special Elections held before the Spring Quarter Elections.
Notices. All information regarding the elections process, calendar, location, and hours of polling sites and other relevant information, must be conspicuously posted and advertised to the ADS or the appropriate Class in a timely manner.
Candidacy Declarations. All candidates for an ADS Officer or Class Officer position shall declare their candidacy and a written declaration to the ADS Secretary no later than ten (10) calendar days before a scheduled election date.
TERMS OF OFFICE.
Freshman Class Officers. For newly elected D1 and DH1 Class Officers, their term starts immediately upon the notification of election results by the ADS Vice President and ends when new officers are elected during the following Spring Quarter.
All Other Class Officers. For newly elected D2, D3, D4, and DH2 Class Officers, terms run from the first Student Liaison Committee and/or the first ADS meeting following that Spring Election to the following Spring Election. In addition, the D4 President’s and DH2 President’s term will run until the end of the Senior Year.
ADS Officers. For ADS Cabinet Officers:
Terms will run from Spring to Spring, as for Class Officers.
Although the outgoing officers may not vote in Executive Council, they are invited to attend ADS meetings, especially the Budget meeting, and offer counsel and guidance for the incoming officers in their decisions.
Outgoing ADS Cabinet and Executive Board officers shall be afforded all privileges, i.e., dinners and functions, etc., attached to their office from the end of their term, third week of the Spring Quarter until the end of the academic year, end of the Spring Quarter.
Transition Duties. Incoming and outgoing ADS and Class Officers should work together to arrange orderly transitions between administrations.
Initiatives.
Intent of this Section.
It should be emphasized that each member of the Executive Council has a responsibility to represent faithfully and adequately the entire ADS or the entire Class, as applicable, in relevant matters.
In such cases in which an ADS member determines that an issue has not been sufficiently addressed, this Section E provides a mechanism for resolutions to be introduced to the Executive Council by an alternate mechanism.
Initiative Procedure.
General.
Proposed initiatives must be sponsored and signed by ten (10) members of the ADS at large.
Proposed initiatives may be presented to any member of the Executive Board or ADS Cabinet, which obligates that member to present the initiative when he or she has the floor at the very next Executive Council meeting.
Procedures. Proposed initiatives will be considered by the Executive Council in an expeditious manner.
Initiatives Sponsored by ADS Members. An initiative that does not amend the Constitution or that does not call for the impeachment of an officer may be immediately approved by a simple majority vote of the Executive Council. If such an initiative fails to be approved by the Executive Council, the ADS President is then obligated to call a Special Election before the ADS membership to decide the issue by simple majority.
Initiatives Amending the Constitution. All initiatives proposing to amend this Constitution shall follow the procedures set forth in this Constitution. All such initiatives shall (i) require the signatures of ten percent (10%) of the members of ADS to qualify for submission to a vote before the ADS in a Special Election and (ii) be submitted to the ADS Secretary who shall, within seven (7) calendar days after receiving the petition, certify that the petition has the required signatures. If the petition does not have the required signatures, the ADS Secretary shall notify the person submitting the initiative that the initiative does not qualify for a Special Election.
Initiatives for the Impeachment of ADS and Class Officers. Subject to the provisions of this Constitution and upon presentation of a valid initiative calling for the impeachment of an officer, the ADS President will call and preside over a special session of the Executive Council. In the case of the ADS President being the officer in question, the ADS Vice President will call and preside over the special session. The officer brought before impeachment proceeding will be allowed to present arguments during the special session of the Executive Council. Impeachment will require a 3/4 vote of the entire Executive Council. An impeached officer will be immediately removed from office and will immediately surrender all materials pertaining to the office.
Initiatives Sponsored by the Executive Council. The Executive Council may, at its discretion, and by a majority vote, submit any matter, other than an amendment to this Constitution or a motion to impeach an officer, to a vote before the ADS in a Special Election. The ADS President shall formally call for the Special Election and set a specific date for the Special Election.
ADS Secretary Duties.
Notices. The ADS Secretary shall post notices of a Special Election fourteen (14) calendar days before the election. Such notice shall include a full text of the initiative and shall be posted in a conspicuous place.
Statements. The ADS Secretary shall receive from any ADS member statements that support or oppose an initiative and then post such statements in a conspicuous place seven (7) calendar days before the Special Election. All supporting and opposing statements must be submitted to the ADS Secretary no later than ten (10) calendar days before the Special Election.
Amendments to the Constitution
Amendment Procedures. Amendments to this Constitution may occur by initiative or by the procedures set forth in this Section.
Constitution Committee Membership. The ADS President shall, at the beginning of each term, appoint one (1) member from each class and, at the discretion of the ADS President, two (2) members at large, to a standing committee, which shall be known as the “Constitution Committee.”
Constitution Committee General Duties. The Constitution Committee shall, from time to time, meet, review the provisions of this Constitution, and by majority vote, recommend submitting to the Executive Council proposed written amendments to this Constitution. Upon receiving a proposed amendment from the Constitution Committee, the Executive Council shall approve or reject the proposed amendment by majority vote. If approved by the Executive Council, the proposed amendment shall be submitted to a vote before the ADS in a Special Election.
Constitution Committee Initiative Recommendations. The Constitution Committee shall meet, review the text of any properly submitted initiative, and write a statement that recommends adoption or rejection of the amendment or affirmatively makes no recommendation. The Constitution Committee shall submit its recommendation to the Executive Council, which shall, by majority vote, approve or reject such recommendation or substitute its own recommendation. Following such vote, the Executive Council shall submit its recommendation to the ADS Secretary who shall treat such recommendation as a statement submitted by an ADS member.
Special Elections Constitutional Amendments. The date of a Special Election shall be no later than thirty (30) calendar days after the approval by the Executive Council or thirty (30) calendar days after the ADS Secretary certifies that the initiative has the required signatures.
Special Elections ADS Secretary Duties. The ADS Secretary shall post notices of a Special Election for amendments to this Constitution fourteen (14) calendar days before the Special Election. Such notice shall include a full text of the amendment and shall be posted in a conspicuous place.
Supermajority Requirement. An amendment will be ratified by a two-thirds majority of votes cast in the Special Election and will take effect upon certification by the ADS Vice President and the ADS Secretary that such amendment has received a two-thirds majority of votes cast in the Special Election.
FINANCES
Income. ADS may derive income from the following sources:
Fees collected by the UC Regents in connection with registration fees and other fees; distributed through ASUCSF;
Moneys invested in the General University Endowment Fund through the Office of the Dean;
ADS sponsored fund raisers;
Fees imposed on ADS sponsored dinners and events; and
Any other funding not in conflict with any laws, rules, regulations of the State, University of California, UCSF Campus, School of Dentistry, City of San Francisco or this Constitution.
ADS Budget
Fiscal Year. The fiscal year of ADS shall run from July 1st to June 30 of each year, or shall be designated by the ADS Treasurer and approved by majority vote of the Executive Council.
Budget Requests. The Cabinet, each Class President, and one representative each from Organized Dentistry Groups and dental RCOs shall, prior to the start of the fiscal year, submit to the ADS Treasurer a budget request for the next fiscal year.
Initial Budget. The ADS Treasurer shall preliminarily identify sources of income, take all budget requests submitted by the Cabinet, Class Presidents, Organized Dentistry Groups and dental RCOs, and prepare an Initial Budget for review by the Executive Council and all parties that have previously submitted budget requests within forty-five (45) calendar days of the start of the fiscal year.
Intermediate Budget. The Cabinet shall meet, within sixty (60) calendar days of the start of the fiscal year to review the Initial Budget and, by majority vote, make such adjustments to each of the budget requests it deems necessary or appropriate. Upon the completion of the Cabinet meeting, the ADS Treasurer shall take the Initial Budget and the adjustments approved by the Cabinet and prepare an Intermediate Budget for review by the Executive Council and all parties that have previously submitted budget requests. Expenditures and amounts set aside as permanent reserves in the Intermediate Budget shall not exceed anticipated sources of income.
Budget Meeting and Final Budget. The ADS President shall schedule a meeting (the “Budget Meeting”) that shall occur within fourteen (14) calendar days of the meeting which the Executive Board of the ASUCSF shall determine its final budget. At the Budget Meeting, parties who have submitted budget requests may petition and address the Executive Council for an increase in certain line item amounts reflected in the Intermediate Budget. Upon hearing such petitions and addresses, the Executive Council shall make such adjustments it deems necessary or appropriate to each of the line items in the Intermediate Budget. The Budget Meeting shall not conclude until the Executive Council approves, by majority vote, the Intermediate Budget, as adjusted (the “Final Budget”). Expenditures and amounts set aside as permanent reserves in the Final Budget shall not exceed anticipated sources of income. No adjustments shall be made to Final Budget subsequent to the conclusion of the Budget Meeting; provided, however, that parties may petition the Executive Council with new budget requests in light of new sources of income.
Request Conditions. Receipt of funds by dental RCOs shall be contingent upon the presence, on a regular basis, of a dental RCO representative at ADS meetings and upon the submission, on a regular basis and to the Editor-in-Chief, of articles explaining the campus activities of the dental RCO.
Treasurer Search Committee
A committee, comprised of the ADS President, the ADS Vice President and the ADS Treasurer, shall meet two (2) months before the Spring Elections, and from time to time thereafter, to create a list of possible nominees for the position of ADS Treasurer.
The incoming Executive Council shall not be obligated to appoint an individual listed by the Treasurer Search Committee. The incoming Executive Council may appoint and approve an individual not identified by the Treasurer Search Committee.
Permanent Reserves and Prior Debts
No less than 5% of the estimated income or the total balance, whichever is larger, shall be set aside as a reserve for the remainder of the fiscal year.
No reimbursements will be paid, or debts incurred, by ADS until sufficient income exists to pay all debts outstanding from prior fiscal years.
Disbursements
Moneys will be disbursed using procedures established by the ADS Treasurer in order to promote organization and hasten payment.
The ADS Treasurer should arrange for at least one official to disburse funds in his/her absence.
Impeachments and Vacancies for ADS Cabinet Offices
Impeachment
A member of the Executive Council may be subject to impeachment if he/she grossly fails to perform the responsibilities of his/her position.
An impeachment proceeding may only be initiated by the initiative process, as described in this Constitution.
Vacancies or Absences
If the office of the ADS President is vacated for any reason, the ADS Vice President will assume all duties and responsibilities.
If any Cabinet office other the ADS President is vacated, the Executive Cabinet may determine whether to appoint a replacement or to call a Special Election.
JUDICIAL HONOR CODE
The ADS strongly supports the UCSF School of Dentistry Student Honor Code in its entirety.
Students are urged, at all levels, to openly discuss what academic honesty and dishonesty entails to avoid misunderstandings between students.
Students are urged to work together to resolve claims of dishonesty expeditiously, either in a direct manner, or with peer/faculty assistance.
Students should be familiar with how to file a formal complaint through the Office of the Dean if it is warranted.
Informal Resolution & Reporting Procedures. In accordance with the Dean’s Ethics Committee, the following procedures shall be followed in addressing complaints of student academic misconduct:
At the discretion of the student bringing an allegation, his/her Class President should be initially notified of any incidents of academic misconduct. The student bringing the allegation has the option of taking the complaint directly to the Dean and bypassing the informal resolution process described in this section.
The ADS President and the appropriate Class President are encouraged to meet with the complainant and suspect to attempt a resolution at an informal level.
In such an informal meeting, the parties should attempt an initial resolution, but if such a resolution does not occur, the original complainant is encouraged to follow established procedures by filing a formal complaint with the Dean’s office.
The ADS President and ADS Vice President will serve on the School of Dentistry Ethics Committee, to consider all issues of student misconduct that have been formally brought to the attention of the Dean.
The ADS President will be responsible to report to the School of Dentistry Ethics Committee, and the Student Liaison Committee, on an annual basis, the nature, incidence rate, and subsequent resolution of informal student complaints of misconduct or academic dishonesty.
Membership on Dean’s Hearing Committee. If a formal complaint is filed and unofficial investigations have been initiated, the following students will serve on the Dean’s Hearing Committee:

Enabling Clause
This Constitution, as amended and revised, will be effective immediately upon ratification of a two-thirds (2/3) majority of those votes cast during a Special Election.
